Terms of Service

These terms cover your use of northfact.com and the Northfact application. They are an agreement between you and ARKA ZENITH IT CONSULTANTS - FZCO (“we”, “us”), the company registered in the United Arab Emirates that operates Northfact. By joining the beta or connecting an account you agree to them. If you do not, please do not use the service.

What Northfact is

A tool for scheduling social media content and measuring how it performed. It connects to accounts you already control, through the platforms’ official APIs and only with your authorisation.

The beta

Northfact is in beta and free. That has consequences you should hold in mind:

• Features will change, and some will be removed
• There is no uptime guarantee. Assume it can be unavailable
• Data may be lost. Keep your own copy of anything you cannot lose
• We may contact you about the beta itself; every email carries an unsubscribe link

We will give at least 30 days’ notice by email before charging for anything, and beta access does not silently become a paid subscription.

Your account and your responsibilities

You must be at least 16, and you must have the right to manage the social accounts you connect. Connecting an account you do not control, or one you have not been authorised to manage, is not permitted.

You are responsible for what you publish through Northfact. We do not review content before it is posted.

You agree not to use Northfact to break the law, to break the terms of the social platforms it connects to, to publish content you have no right to publish, or to attempt to access other customers’ data.

If you connect a client’s account

Agencies and freelancers are welcome, and connecting an account on behalf of someone else carries three obligations that are yours rather than ours:

• You have that client’s authorisation to connect the account, to publish from it, and to have its performance data analysed. We take your word for it; we cannot verify it.
• You have told that client, in whatever privacy notice you give them, that a third-party tool processes their data on your behalf. Our Privacy Policy describes what we do with it, and we are the processor in that arrangement while you remain the controller.
• You remain responsible for what is published from an account you connected, including by anyone you give access to your Northfact workspace.

If a client asks you to remove their data, you can do it yourself by disconnecting the account, and Deleting your data explains exactly what that removes. If a client comes to us directly we will point them back to you and tell you they asked.

Platform rules apply too

Northfact operates within Instagram, Facebook and Threads. Their terms govern your accounts on those platforms. We cannot override a platform decision, and we are not responsible if a platform restricts, suspends or removes your account.

Platform APIs change without notice. Features that depend on them may stop working, and sometimes without warning to us either.

Who owns what

You own your content - everything you publish, and your account data. You grant us only the permission needed to provide the service: to store, process and display that content back to you, and to publish it where you instruct us to.

We own Northfact - the software, the analysis, the interface, the brand. You may use the service; you do not receive any rights in it. Reverse engineering it, or extracting the methods behind it for a competing product, is not permitted.

Reports Northfact generates are yours. Use them with clients however you like.

Ending it

You can stop at any time. Disconnect your accounts or email us. We will delete your data as described in the Privacy Policy, and Deleting your data sets out both routes and what each one removes.

We may suspend or end access if these terms are broken, if the service is being used in a way that threatens it for others, or if we discontinue the beta. Except in cases of abuse, we will give reasonable notice and an opportunity to export your data.

Warranties and liability

The service is provided as is. We do not warrant that it will be uninterrupted, error-free, or that every metric will be complete - platform data availability is outside our control, and Northfact is deliberately explicit about where a number came from precisely because of that.

To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profits, or lost data. Where liability cannot be excluded, it is limited to the amount you have paid us, which during the beta is nothing.

Nothing here limits liability for death, personal injury, or fraud.

Changes

We may update these terms. If a change materially affects you we will email you before it takes effect. Continuing to use Northfact afterwards means you accept the new version.

Law

These terms are governed by the laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction - without affecting any consumer rights you have under the law where you live.
